Please read carefully and review the following terms and conditions. You, the client, must agree to all the following terms and conditions set forth before any work will commence. In certain situations, Frozen Creative may ask for a signed copy of the agreement before we begin any work on your project.

We accept cash, money orders, most credit cards and personal/business checks. Regarding personal/business checks: design will not begin and files will not be sent to print until payment clears.

A non-refundable 50% deposit is required to begin your design process. You will not be placed on our design schedule until this deposit is paid in full. This does not apply to jobs totaling less than $100. Jobs totaling $100 or less are required to be paid in full.

Once the design portion your print request or web site is complete, final payment is due. Frozen Creative LLC will not send files for print, make your site, “live” or remove any digital watermarks until all outstanding balances are paid in full.  Unpaid balances over 15 days are subject to a late fee of 10% of the remaining balance, with a minimum charge of $25.

If your project goes beyond schedule and over budget due to added project elements, an additional payment will need to be made before we will proceed with any work. We will then create a new invoice for the additional work to be completed.

Due to the nature of our fast-paced business, we process orders as soon as they are paid for and approved. If you need to cancel an order you have placed, you must call and speak to a Frozen Creative LLC representative. If we can stop the order before it goes to print, we will be happy to cancel it, but if the order goes to print and is scheduled for production, you are responsible for full payment.

Due to the digital nature of this business Frozen Creative LLC DOES NOT offer refunds or exchanges whatsoever. You are however allowed to cancel before any work is done to your web or graphic design.

Once your deposit and/or full payment has been received, your project is accepted and placed on the design schedule. No refunds are permitted under any circumstances. Your deposit is a retainer. Your deposit also covers any costs that may occur before the actual design process begins, such as hosting fees, graphic fees, etc.

Frozen Creative LLC agrees to not disclose any confidential communication. 
We will not sell, trade or distribute any of your information.

All written quotes are guaranteed for 7 days. Your quote covers the cost of the design and the designer’s billable hours.  There are no refunds or exchanges on design layout service; however we at Frozen Creative LLC will strive to achieve mutual satisfaction.  If you are unhappy with your design we will make every reasonable attempt to make the changes necessary to fulfill your needs.

Your quote covers the cost of one (1) initial layouts and three (3) revisions. Any additional drafts will be billed according to time.  Frozen Creative LLC will not do unlimited layouts, backgrounds, logo designs or print layout for the cost of your initial quote.  While your ultimate satisfaction is our goal… Any additional drafts will be billed at the rate of $65 per hour.

Please be clear on your design needs, as this will save you time and money. Frozen Creative LLC asks that you fill out the design questionnaire that will be provided to you before your project begins, as completely as possible.

If the client requests work that has not been detailed in the original quote, this work will be considered a revision and will be billed separately. If it is evident that the Client has been unclear about the needs of the project, estimates are subject to adjustment at the discretion of the Frozen Creative LLC. Billing will reflect the actual costs incurred.

Before Frozen Creative LLC begins work on any graphic request including: print, web, logo design or web assets, we must have all required elements of the project in hand. This includes:

  • Photos – Must be web or print ready as they relate to your project. Web ready 72 dpi. Print ready 300 dpi.
  • Logos – Need to be in vector or high resolution format. 300 dpi.
  • Copy – Copy for each page or layout must be in final proof read format.
  • Color Choices
  • Contact Information

Frozen Creative LLC can be hired to provide copy for each web page or ad layout at an additional rate per page.  If you, the client declines this service, you must provide us with all site text in a final proofread form.  We will not edit copy that is not written by our team.  While we may catch random spelling errors it is your responsibility to write, edit and approve your copy prior to the layout of your site.  Any copy editing will be billed at the rate of $40 per hour.

Proofs will be sent to the customer for approval. The customer is responsible for checking all of the information on the project for accuracy, especially the text. Once the project has been proofed and approved, please reply via e-mail (preferred) or telephone with your comments or corrections.  Frozen Creative LLC cannot be held responsible for any errors on projects that have been proofed and approved by the customer.

All photos you provide must be in web or print ready format as they relate to your project. Your initial quote does not cover the cost of photo enhancement.  An additional fee will be incurred for any and all photo editing required.  Additional fees will be charged for any photo editing including; retouching, color correction, cropping, brightening, sharpening and all other forms of cleaning up your images.  We will resize photos as necessary to implement them into the design of your project.  All photo editing will be billed at the rate of $30 per image.

Client agrees that all images, text and copy provided to Frozen Creative LLC for inclusion into any web site or graphic design are property of the client or have been given permission from the rightful owner to use each of these elements, and the Client agrees to hold harmless, protect, and defend Frozen Creative LLC from any claim or law suit against Frozen Creative LLC arising from the use of any and all  elements provided to us the Client. The Client agrees to indemnify and hold harmless the Frozen Creative LLC against any and all claims, costs, and expenses, including attorney’s fees, due to materials included in the Work at the request of the Client for which no copyright permission or privacy release was requested or uses that exceed those allowed pursuant to a permission or release.

If you do not have imagery, at your request, we are able to provide stock images within your design. Licensing fees will be included in your quote.

New work requested by the client and performed by the designer after a proposal/estimate has been approved is considered a revision. If the job changes to an extent that substantially alters the specifications described in the original estimate, both parties must agree upon a revised additional fee before further work proceeds.

If at any time during a project the client becomes unavailable for a period of 30 days , Frozen Creative LLC will consider the project completed. Frozen Creative LLC will not refund nor credit client. Again, please be sure that you are ready to complete your project.

Before Frozen Creative LLC begins any web design project we will give you our best estimated time of completion. This estimate depends on many key factors such as but not limited to; content, functionality, and size. If client does not provide content by the due date established in the original contract payment in full is still due. Should client be unable to provide all content in a timely manner Frozen Creative LLC reserves the right to reschedule completion of your web site project to later date and our teams availability.

Communication is essential to the development of your project. Frozen Creative LLC agrees to respond to all communications within 1 business day of contact.

We ask that you make yourself available to respond via email to our communications within 24 hours of contact. This will insure that your project remains on schedule and within budget.  Most print design jobs are allotted one week for completion and web designs are allotted 10 business days for completion. Your availability during this time is essential. If at any time during your design schedule you become unavailable and do not notify us, we reserve the right to re-prioritize your project according to our pending deadlines.  This may mean that your project deadline will be delayed.

While we know that some clients may feel more comfortable conveying their ideas and designs over the phone, we ask that all request for design changes be made in writing via email.  This allows for the Frozen Creative LLC team to refer back to accurate correspondence during your project and will protect you and us from costly design errors.

The client agrees that your completed print work, web site or custom work may be included in the portfolio or for the purpose of advertisement of Frozen Creative LLC.

The client agrees to keep a small text link back in the footer of the website to Frozen Creative LLC. The client agrees not to remove this link unless text, images, designs elements, content, and code created by us are removed. If you would prefer not to have this link added, it can be removed for the removal fee of $250.

In the event of cancellation of an assignment, ownership of all copyrights and the original artwork shall be retained by Frozen Creative LLC.

Upon completion and final payment of your web site project you will have full ownership of all images and elements used in your site. As we work through the building phase of your web site, logo, print project or custom design you will receive drafts versions and concepts. These preliminary drafts are NOT your property. They are the property of Frozen Creative LLC. They may not be used by you.

Upon completion and final payment of your web site or print project you will have ownership of the final flattened files.

If the native InDesign, Photoshop, or Illustrator files are requested, there will be an artwork release fee of 25% the total design or a minimum of $250. The original artwork remains copyrighted to Frozen Creative LLC. We DO NOT provide you with the layered files of the design unless this agreed upon in writing at the beginning of your project by Frozen Creative LLC. What you’re paying for here is data and convenience. It’s data, files, that Frozen Creative LLC created, that will provide you with a level of convenience that has value beyond the contracted design.

Frozen Creative LLC will not be liable for breach of this agreement where that breach was due to software, hardware or electrical failure, natural events such as fire or other events beyond the control of Frozen Creative LLC.

Claims for defects, damages, and/or shortages must be made by the client in writing to Frozen Creative LLC within a period of 2 days after project completion. Failure to make such claim within the stated period shall constitute irrevocable acceptance and an admission that the Project fully complies with terms, conditions, and specifications.

All packages are shipped via UPS. Additional fees may apply. Frozen Creative LLC cannot ship to P.O. Boxes, Army Post Office (APO) and Fleet Post Office (FPO). It is against Federal law for anyone other than a postal employee or the box user to access the box. It is the client’s responsibility to set up delivery arrangements. This can be done once you receive tracking information from Frozen Creative LLC. This would include shipping directly to the UPS delivery office in your city or another location where there is someone to receive the package. Once a package is confirmed delivered, neither Frozen Creative LLC or UPS can be held responsible if a package is stolen or damaged.
